WHIPPERSNAPPER GAMES TERMS OF USE

1. Using Whippersnapper

Whippersnapper offers a collection of games for entertainment. You may use the app for personal, noncommercial purposes in accordance with these Terms and applicable app-store rules.

If you download Whippersnapper through Apple’s App Store, your use is also subject to Apple’s applicable Licensed Application End User License Agreement, including Apple’s standard EULA where applicable. If these Terms conflict with mandatory app-store terms, the applicable mandatory terms control.

2. Optional Player Name and Local Data

You do not need to create an account, provide an email address, or choose a username to play. You may optionally enter a Player Name in your Profile. This name is intended for use only within your own app and is not publicly displayed.

Game scores, progress, achievements, and preferences are currently stored on your device, not in a Whippersnapper cloud account. You are responsible for your device and for preserving any local data you wish to keep. Deleting the app or resetting your device may erase local progress.

3. No Public Leaderboards or Player Communication

Whippersnapper does not currently offer public leaderboards, public player profiles, or player-to-player messaging. If leaderboards are introduced in the future, participation will be optional and require the player’s affirmative consent (opt-in). Before introducing leaderboards, we will explain what information would be displayed or shared and update these Terms and our Privacy Policy as appropriate. We may introduce or change other features in the future.

4. Age and Accessibility

Whippersnapper is designed primarily for older adults and is not marketed or directed to children under age 13. Parents or guardians may choose to purchase the app for their children, and children may play with appropriate parental or guardian supervision. We strive to provide an enjoyable, worry-free experience for players of different ages and abilities. A parent or legal guardian should review and authorize any purchase made by a minor.

5. Purchases and Subscriptions

Some features or access may require payment. Prices, available purchase options, and any subscription terms will be shown before purchase.

If offered, subscriptions renew automatically at the disclosed billing interval unless canceled according to the applicable app store’s procedures. Subscription management, cancellation, and refunds are generally handled through the app store where you purchased access.

If offered, a lifetime purchase provides access for the supported lifetime of the Whippersnapper app or applicable product offering, not a guarantee that the app or every game will be available forever.

6. Our Commitment to Worry-Free Play

Whippersnapper is designed without third-party advertising, disruptive advertising pop-ups, or links intended to direct players to outside advertisers. Sponsor acknowledgments may appear within the app. We may change or discontinue particular games or features as needed.

7. Games Are for Entertainment

Whippersnapper games are provided for enjoyment and recreation. They are not medical treatment, diagnostic tools, or a guarantee of improved memory, cognition, or health.

8. Scores, Progress, and Availability

Game scores, times, statistics, progress, and achievements, where available, are for personal use and are stored locally on your device. Whippersnapper does not currently collect gameplay statistics or game-popularity totals. Local information may be affected by updates, device changes, software errors, or removal of local data. We cannot guarantee that progress will always be recoverable.

9. Intellectual Property

Whippersnapper and its games, designs, text, artwork, software, names, and other content are owned by Whippersnapper Games LLC or its licensors and protected by applicable intellectual property laws. You may not copy, redistribute, reverse engineer, or commercially exploit the app except as permitted by law.

10. Updates and Changes

We may update, improve, replace, or discontinue games, features, or the app itself. We will try to make reasonable decisions about changes, but uninterrupted availability is not guaranteed.

11. Misuse and Termination

You may not interfere with the app’s operation, attempt unauthorized access to our systems, or use the app unlawfully. We may restrict access where reasonably necessary to address misuse, security risks, or legal requirements.

12. Disclaimer of Warranties

To the extent permitted by applicable law, the app is provided “as is” and “as available,” without warranties of any kind, whether express or implied. Nothing in these Terms excludes rights that cannot legally be excluded.

13. Limitation of Liability

To the extent permitted by applicable law, Whippersnapper Games LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the app. Any other liability is limited to the maximum extent permitted by applicable law.

14. Privacy

Our Privacy Policy explains how information is handled, including optional Player Names and gameplay information currently stored on your device. Whippersnapper does not currently collect gameplay statistics or game-popularity totals. Please review the Privacy Policy alongside these Terms.

15. Changes to These Terms

We may update these Terms from time to time. We will change the Last Updated date when we do so. Where required, we will provide additional notice. Continued use after updated Terms become effective constitutes acceptance to the extent permitted by law.

16. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, United States, except where applicable consumer-protection law requires otherwise.
